Welcome to Purely Positive Kids ("Purely Positive Kids", "we", "us"). These terms apply to purelypositivekids.com, our installable web app, and our games, songs, stories and classroom activities (together, the "Service"). By using the Service you agree to these terms. If you don't agree, please don't use the Service.
1. Who can use the Service
Children may enjoy the Service with the help and supervision of a parent, guardian or teacher. Accounts, purchases and memberships are for adults only (18 or older). By creating an account you confirm you are an adult and that you are responsible for how children use the Service under your account.
2. Free features
Many parts of the Service are free and need no account, including a selection of our songs, nursery rhymes, audio stories and read-along storybooks, starter games and some classroom practice. We may change which features are free at any time.
3. Free trial
- New accounts get one free 24-hour trial of all membership features. An email address is required to sign up; no payment card is needed for the trial.
- One trial per person and household: each email address can be used for only one account, and we may decline a trial if one was recently used from the same internet connection.
- When the trial ends, your account returns to the free features unless you choose a membership.
4. Family Membership and billing
- The Family Membership is offered monthly or yearly at the prices shown on our Membership page when you sign up. Prices are in U.S. dollars and may not include taxes that apply where you live.
- Memberships renew automatically at the end of each billing period, and your payment method will be charged, until you cancel.
- You can cancel anytime from the Membership page ("Manage my membership"). When you cancel, you keep access until the end of the period you already paid for, and you won't be charged again.
- Payments are processed by Stripe. We never see or store your full card number.
- Except where the law requires otherwise, payments are not refundable for partial periods. If something went wrong, please contact us and we will do our best to make it right.
- If we change membership prices, we will tell you before your next renewal, and you can cancel before the new price applies.
5. Coins, stars, XP and the leaderboard
Coins, stars, XP, levels, trophies and unlocked games are just-for-fun game features. They have no money value, can't be bought, sold or exchanged for cash, and may be reset or changed. Progress is saved on your device and can be lost if you clear your browser data. If you join the leaderboard, please use a first name or nickname only; we may remove names that aren't kind or appropriate.
6. Your account
Keep your username and password private, and tell us if you think someone else has used your account. You are responsible for activity on your account. We may suspend or close accounts that break these terms or misuse the Service.
7. Kind and safe use
Please don't try to break, overload, copy, scrape or get around the locks of the Service, don't use it for anything unlawful, and don't send us anything harmful, hateful or that isn't yours to share.
8. Our content
Our characters (including Harper, Kaevin, Kayden, Skylar, Sunny Beats and Wobbles), stories, songs, games, artwork, voices, logo and designs belong to Purely Positive Kids and are protected by copyright and trademark law. You may use the Service and print our free worksheets and coloring pages for personal, family and classroom use. Please don't copy, sell or re-publish our content without written permission. Traditional nursery rhymes are in the public domain; space pictures are credited to NASA and its partners where shown.
9. Learning, not a substitute for school
Our classroom practice and facts are for fun and extra practice. We work hard to keep them accurate, but they are not a substitute for a teacher, school curriculum or professional advice.
10. No warranties
The Service is provided "as is" and "as available". We don't promise it will always be available, error-free or that saved progress will never be lost.
11. Limits on our liability
To the fullest extent the law allows, Purely Positive Kids is not liable for indirect, incidental or consequential damages, and our total liability for any claim about the Service is limited to the amount you paid us in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you.
12. Changes
We may update these terms. If the changes are important, we'll post a notice on the site. Continuing to use the Service after changes means you accept the new terms.
13. Governing law
These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules.
